Transport for London:
Executive London Group Limited will be hereafter referred to as ELG Cars.
ELG Cars and its drivers are Authorised and Regulated by Transport for London.
ELG Cars and its drivers fully comply with all requirements, rules and regulations set out by Transport for London.
Accounts:
Account applications are available.
Account customers will be invoiced on the last day of the month. Payment is required within the agreed time from date of invoice.
Failure to finalise the account may result in a withdrawal of account facilities and transport services.
Animals:
Animals shall not travel without written permission from ELG Cars.
We welcome registered guide dogs, but prior warning would be appreciated.
Airport & Cruise Liner Pick Up:
Should you be unable to locate your driver upon arrival please contact airport / cruise information desk and ask the driver to be paged or alternatively please contact the office number. Should you fail to contact the office prior to leaving the area a cancellation fee maybe made incurred.
Our drivers will wait for a maximum for 3 hours at the Airports before pulling off, unless specifically instructed by the clients to wait for longer and every hour is charged at £30 per hour.
Accommodation:
Should the chauffeur be required to travel and spend overnight in accommodation the costs will be subject to an accommodation and subsistence allowance according to the quotation.
Bookings:
All journeys must be pre-booked.
All pre-booked journeys are quoted before journeys start.
Bookings will be accepted via phone, email or online web booking.
Passengers will be sent driver's name and photo, driver's licence no, Vehicle Mark, driver's mobile no and 24 hours customer help line for passengers.
For all correspondence regarding the booking please quote the booking details. ELG Cars will accept the booking with the understanding that the hirer fully accepts and agrees to the terms and conditions herein.
ELG Cars will always make sure that drivers arrive at least 10 minutes before the pickup for journeys to the airports, however in the unforeseen circumstances where driver is unable to get to the passenger in time due to accidents or unexpected traffic, ELG Cars will not be liable for any losses incurred by its clients.
Cancellations:
Customers are free to cancel any booking without incurring any charge or penalty.
All vehicles and chauffeurs are fully insured. They are licensed by the Transport for London (TfL) Taxi & Private Hire license. For any issues regarding the license, operator and or driver in the first instance please contact this office or alternatively please contact Transport for London Taxi & Private Hire
Chauffeurs:
All our chauffeurs are DBS checked. The hours of operations for the chauffeur are regulated by the law according to an EU directive.
Neither the hirer nor passenger shall delay or interrupt the journey in such a way that the chauffeur is breaching the law. If such a breach occurs the hirer is responsible for additional costs incurred.
Children:
By law small children require additional appropriate restraints. We neither provide nor assist in the fitting of child seats or restraints.
It is the passengers’ entire responsibility to make sure any children in his/her care are properly secured.
Please advise the booking office when children are traveling.
Complaints Procedure:
In the unlikely event that you should have cause for complaint, any complaint must be made in writing within 14 days. Our investigation will determine validity and if necessary, an independent assessment will be commissioned.
If it is found that ELG Cars have been at fault in not supplying the service that you have asked us to provide, then a refund may be applicable. All refunds will be made on an individual basis and any refund will be made appropriate to the nature of the complaint and limited to the amount paid for the hire.
Confirmation:
Normally a written confirmation by the company is the only basis of acceptance of hiring or subsequent alterations.
Departure Time:
Departure and journey times may be suggested after making allowances for the day of travel and traffic conditions at these times. ELG Cars will not be responsible for clients insistence for any variation to the recommended times or delay to agreed departure time, which may result in missed flights, connections or meetings or any other loss.
Any delay during a journey caused by the passenger is solely their own responsibility. The chauffeur must not be asked to speed or drive recklessly to make up time.
Disorderly Behaviour:
The chauffeur reserves the right to refuse any passenger/s that are deemed to be under influence of alcohol or drugs and that maybe deemed to be a danger or nuisance to property, passengers or other persons. No refund or compensation will be made under these circumstances. The company may request the assistance of the police to remove the offenders to protect the chauffeurs, passengers or property.
Food or Drink:
Food & drink (particularly alcoholic beverages) may not be consumed on the vehicle without prior written consent.
Our chauffeurs retain the right to refuse passengers from eating or drinking in the vehicle other than the mineral water provided.
Should any damage occur because of the passenger’s actions to a vehicle or property, the full costs of repair and loss of income will be invoiced.
In the event of vomiting in the vehicle the cost of cleaning and loss of income will be invoiced.
Gratuities:
Tipping or gratuities are purely at the passenger’s discretion and may be paid directly to the driver on the day. If you wish to have the gratuity as part of the tax invoice, please advise the booking office prior to the journey taking place.
Law:
The Law in England and Wales applies to all contracts, and the terms and conditions form part of the contract whether made verbally or in writing.
Insurance:
Our company, vehicles and chauffeurs are fully insured for passenger or third party claims under British law however property is carried at the passengers’ own risk. ELG Cars will not be held responsible for loss or damage to property.
Liabilities & Delays:
Every effort will be made to get you to your destination on time. ELG Cars is not liable for any loss due to delays caused by unforeseen circumstances such as but not limited to – mechanical breakdown, unpredictable incidents, traffic jams, road works, road closures, diversions, extreme weather conditions, collisions caused by other parties or terrorist attacks. The company may cancel all services and may refund in the event of circumstances beyond our control.
Our Chauffeurs will choose a route using their experience & knowledge of local conditions. They will be happy to accept an alternative route as requested by passengers, however should this result in extra miles or time; an extra charge may be levied. ELG Cars or its drivers will not be responsible for any losses incurred due to the chosen route at the time of journey.
In the instance of last-minute mechanical breakdown, exceptional traffic difficulties, incidents, accidents or any events beyond our control, we will endeavour to supply another vehicle ASAP.
Licensing:
All vehicles under 8 passenger seats and chauffeurs are fully insured. For any issues regarding the license, operator and or driver in the first instance please contact this office or alternatively please contact Transport for London Taxi & Private Hire
Lost Property:
Our Chauffeurs will check for any items left by their passengers. Any items left by a passenger and missed by our driver will be returned to the office. The items will be logged and secured in accordance with the Transport for London (TfL) Taxi & Private Hire license. However, ELG Cars and its drivers are not responsible for any lost property.
The owner of the property will be notified, where possible and returned to a location of your choice however we may recover reasonable costs for doing so.
Luggage:
Vehicles are subject to restrictions on carrying luggage for safety reasons. The hirer accepts that the chauffeur shall be the sole judge as to whether or what extent passenger’s property is carried.
ELG Cars accepts personal property of the hirer and their passengers on the understanding that it will take all reasonable steps to avoid loss or damage.
The hirer should notify the company or the driver if items of exceptional value are to be carried. It is the hirer’s responsibility to minimize the risk of loss when property is left unattended. Please notify us at the time of booking should you require us to carry excess or oversized luggage.
Parking:
We reserve the right to refuse to wait in un-designated areas or where a fine could be imposed. In circumstances where the chauffeur is requested to wait in one of these areas, then the hirer of the vehicle will be completely responsible for any parking fines incurred.
All our chauffeurs abide by the current laws and regulations governing speed restrictions and will not break these. All parking and toll fees will chargeable to the customer.
Passengers Conduct:
The chauffeur reserves the right to refuse any passenger/s that are deemed to be under influence of alcohol or drugs and may be deemed to be a danger or nuisance to vehicles, passengers or other persons. No refund or compensation will be made under these circumstances. The company may request the assistance of the police to remove the offenders to protect the chauffeurs, passengers or vehicles.
The company will provide a clean and tidy vehicle, in respect the hirer is obliged to leave the vehicle in the standard it was received. Costs of repair, reinstatement or cleaning will be borne by the hirer. If necessary, a cleaning charge will be forwarded to the hirer; please note cleaning such as vomiting is subcontracted to a third-party company. This is very expensive.
All passengers are required by law to use seat belts provided. Our chauffeurs will not commence the journey until all legal requirements are being complied with.
Payments:
We may ask for your credit or debit card details as security for your booking, until full payment has been received
Payment may be made via credit card, debit card, cash, cheque & BACS. Cash and cheque payment methods are subject to prior advisement and approval by ELG Cars.
For Account customers, journeys will be invoiced at the completion of agreed period. Payment is required within agreed terms of the account. Failure to finalise the account may result in a withdrawal of account facilities and transport services.
Invoices must be settled in full by the end of the subsequent calendar month from the date of issuance. Failure to comply with this payment term may result in applicable late fees and potential suspension of services until payment is received.
Should any extra charge be incurred we will notify you before charging.
Privacy Policy:
ELG Cars is subject to the legal requirements of the Data Protection Act (1998) and GDPR (2018) and protects your information held on our systems in accordance with all legal requirements.
Quotations:
Quotations can be verbal or written and will be based on information supplied by the client. The quote will be considered as binding by ELG Cars subject to these terms and will be valid for 30 days.
Any charge for services will be confirmed with the customer either verbally or in writing prior to the relevant journey taking place.
The route used is at the discretion of the chauffeur as agent of the company and then subject to normal conditions prevailing, unless specified by the hirer prior to quotation in which case it will be shown on the confirmation.
Smoking:
In accordance with the 2007 ban which includes smoking on vehicles which serve the public the company operates a strictly no smoking policy in all vehicles. This includes vaping and all forms of electronic smoking.
Subcontractors:
ELG Cars reserve the right to use subcontract chauffeurs when needed, however all services will be provided as per these terms and conditions.
We on occasions use London licensed drivers or operators licensed in London to cover bookings however we reserve the right to, when necessary engage any operator covered by the Deregulation Act 2015 section 11 Private hire vehicles: sub-contracting regulations to perform such services and shall provide the name of such sub-contractor to the Customer upon request, however all services will be provided as per these terms and conditions.
Surcharges:
An additional surcharge will be added to all bookings for services provided on Bank or Public Holidays of 25% and 100% on Christmas day.
Parking, Toll Charges and congestion zone charges and porterage or freight costs, will be charged if incurred. All out of hours bookings i.e. from 0001 hrs to 0600hrs will incur an additional 20% surcharge.
The Hirer:
The hirer acts on behalf of all the passengers travelling. If the hirer is a corporation, society or group an individual must be named as a responsible person and they are agent of the hirer. The hirer is responsible for all actions of passengers on board including any additional costs incurred, whether or not they travel with the party. The company can only accept instructions from the hirer or their appointed agent.
The vehicle will depart at times agreed by the hirer, subject to reasonable period of grace; it is the responsibility of the hirer to account for all passengers at those times. The company will not accept liability for losses incurred by passengers who fail to follow hirer’s instructions.
VAT:
All payments for services and vehicles with 9 seats and less are subject to a VAT of 20% which will be itemised on your invoice. Any service provided with a vehicle of more than 9 seats is not subject to VAT.
Vehicles:
Unless specified as a continuous hire the hirer cannot assume that the vehicle will remain at the destination or be available for their use in the interim period between arrival and departure
The company reserves the right to substitute another vehicle, including those of another operator, for all or part of hiring provided they are of equal or greater value.
A vehicle will be provided with enough seating capacity for the number of passengers booked under no circumstances will the chauffeur permit the authorized seating capacity to be exceeded.
ELG Cars warrants maintaining its vehicles in good order in accordance with the manufacturer’s recommendations.
Waiting Time:
All passengers arriving at Airports within the UK will have 1 hour free waiting time. Additional waiting time is charged at £30.00 per hour plus car park.
